Terms and Acceptable Use

The agreement governing the Service and the rules that apply to accounts, QR codes, content, and destinations.

Use Link My Sign lawfully and responsibly, and make sure your QR destinations and content are accurate, safe, and yours to use. We may restrict harmful or abusive activity, cannot guarantee scans or sales, and our Terms include liability limitations, individual arbitration, and a class-action waiver.

This is a friendly summary only. Please review the full Terms of Service and Acceptable Use Policy below, which are the official and controlling terms.

These Terms of Service ("Terms") are a binding agreement between you and LinkMySign, LLC ("Link My Sign," "we," "us," or "our"). They govern your access to and use of linkmysign.com, our applications, QR code tools, and related services (collectively, the "Service").

Important: Section 18 contains a binding arbitration agreement and class-action waiver. Unless you timely opt out, most disputes must be resolved individually through arbitration rather than in court.

By creating an account, clicking to accept these Terms, or using the Service, you agree to these Terms. If you use the Service for a company or other organization, you represent that you have authority to bind it, and "you" includes that organization.

1. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to create an account, use account features, or purchase the Service.

The Service is currently offered for use in the United States. You may use it only where lawful.

2. The Service

Link My Sign allows users to create and manage QR codes associated with digital or physical signs. Depending on the configured listing type, a QR code may direct a scanner to a third-party webpage or initiate a supported device action, such as opening a phone, text-message, email, or Wi-Fi connection prompt. Link My Sign does not own or control third-party destinations or the scanner's device.

At launch, public Link My Sign-hosted listing pages, native content uploads, and paid digital services are not available. We may add, change, suspend, or discontinue features. Additional terms or updated Terms may apply to future features.

3. Accounts and Security

You must provide accurate, current information and keep it updated. You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity occurring through your account, except to the extent caused by our breach of these Terms or applicable law;
  • promptly notifying support@linkmysign.com of suspected unauthorized access; and
  • ensuring that your use of the Service complies with these Terms and applicable law.

You may not share, sell, transfer, or provide account access in a way that compromises security or evades usage limits. We may require account verification or take reasonable steps to protect the Service.

4. QR Codes, Destinations, and User Content

"User Content" means destination URLs, listing names, phone numbers, email addresses, Wi-Fi connection details, messages, business information, and any other content or information you submit to or configure through the Service.

You retain ownership of your User Content. You grant Link My Sign a worldwide, nonexclusive, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use User Content only as reasonably necessary to operate, secure, support, and improve the Service, enforce these Terms, and comply with law. This license ends when the content is deleted, except for reasonable backup, legal, and technical retention.

You represent and warrant that:

  • you own or have all rights and permissions needed for your User Content and destination URLs;
  • your User Content and destinations are accurate, lawful, and do not infringe another person's rights;
  • you will not use a QR code or destination in a deceptive or misleading manner; and
  • you will comply with our Acceptable Use Policy.

You are solely responsible for the products, properties, vehicles, events, services, offers, listings, claims, and third-party destinations promoted through your QR codes. Link My Sign does not verify or endorse them and is not a party to transactions between users, scanners, buyers, sellers, landlords, tenants, or other third parties.

5. Third-Party Websites and Services

The Service may link or redirect to websites and services operated by third parties, including destinations selected by users and products sold through Amazon. Third-party services are governed by their own terms, policies, availability, and practices. We do not control and are not responsible for third-party content, transactions, privacy, security, fulfillment, refunds, or availability.

You must not configure a QR code to falsely imply that Link My Sign sponsors, verifies, or endorses a destination or offer.

6. Physical Signs, Purchases, Shipping, and Refunds

Physical Link My Sign products offered through Amazon are purchased from the applicable Amazon listing or storefront. Pricing, taxes, payment processing, shipping, returns, replacements, and refunds for those purchases are governed by the terms and policies displayed by Amazon and the applicable product listing at the time of purchase.

The Link My Sign account and QR functionality included with a physical product are not sold as a separate refundable item unless expressly stated. Free features do not have a monetary refund value.

If we later offer paid digital services directly, we will disclose applicable billing, renewal, cancellation, and refund terms before purchase and may update these Terms accordingly.

7. Duration of QR Code and Listing Functionality

Unless a specific offer expressly states otherwise, QR code and destination-management functionality may remain available while:

  • your account and the applicable QR code remain active;
  • you comply with these Terms and the Acceptable Use Policy;
  • required third-party and technical services remain available; and
  • Link My Sign continues to operate the relevant Service.

References to a product's or listing's "lifetime," "permanent" access, or similar wording do not guarantee perpetual operation of Link My Sign or any third-party destination. They mean the supported life of the applicable product or Service, subject to these Terms. We do not guarantee that any QR code, redirect, listing, domain, or third-party destination will remain available indefinitely.

8. Acceptable Use

You must comply with the Acceptable Use Policy, which is incorporated into these Terms. You may not use the Service for illegal, fraudulent, deceptive, harmful, or rights-infringing activity, or to expose minors to content in violation of law.

9. Intellectual Property

The Service, including its software, design, text, graphics, branding, templates, interfaces, and documentation, is owned by Link My Sign or its licensors and protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service except as permitted by applicable law or our written authorization. You may not remove proprietary notices or use Link My Sign's trademarks, logos, or branding without permission.

If you provide feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation.

10. Copyright and Other Rights Complaints

If you believe content or a destination used through the Service infringes your copyright, trademark, privacy, publicity, or other rights, email legal@linkmysign.com with:

  • your contact information;
  • identification of the protected work or right;
  • identification of the content, QR code, or destination at issue;
  • a description of the alleged infringement;
  • a statement that your report is accurate and made in good faith; and
  • any additional information reasonably needed to evaluate the report.

We may remove or disable access while investigating and may terminate repeat infringers where appropriate. This section is not a substitute for any formal notice requirements under applicable law.

11. Suspension and Termination

You may stop using the Service and may archive QR codes or remove listings through available account controls. The account-settings "Close Account" feature deactivates the account, disables login, and archives active QR codes; it does not by itself delete all account or audit records. You may separately request deletion of eligible personal information by contacting legal@linkmysign.com, subject to the exceptions described in the Privacy Policy and applicable law.

We may investigate, restrict, suspend, disable, or terminate access when we reasonably believe:

  • you violated these Terms or the Acceptable Use Policy;
  • your content or conduct is unlawful, fraudulent, deceptive, infringing, harmful, or creates security risk;
  • action is necessary to protect users, third parties, Link My Sign, or the Service;
  • we must comply with law or a valid legal request;
  • fees directly owed to Link My Sign are overdue; or
  • continued operation is no longer commercially or technically feasible.

Where reasonably practicable, we may provide notice and an opportunity to cure, but we are not required to do so in urgent, serious, repeated, or legally restricted situations.

Upon termination, your right to use the Service ends. Sections that by their nature should survive will survive, including provisions on ownership, disclaimers, liability, indemnification, dispute resolution, and general terms.

12. Service Changes and Availability

We may perform maintenance and modify, limit, suspend, or discontinue all or part of the Service. We will use commercially reasonable efforts to avoid unnecessary disruption, but we do not guarantee uninterrupted, error-free, or permanently available operation.

If we discontinue a material paid digital service purchased directly from us, any remedy will be governed by the offer-specific terms and applicable law. Physical-product purchases and refunds remain subject to Amazon's applicable policies.

13. No Guaranteed Results

Link My Sign does not guarantee:

  • scans, visits, traffic, visibility, leads, inquiries, or buyer interest;
  • a sale, rental, transaction, conversion, or other result;
  • the accuracy, legitimacy, safety, quality, or legality of user content or third-party destinations;
  • that a QR code will be scanned or compatible with every device or environment;
  • uninterrupted uptime or permanent availability; or
  • that third-party websites, marketplaces, listings, or links will remain active.

You are responsible for checking printed QR codes, destination URLs, sign placement, listing accuracy, and legal compliance before and during use.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." LINK MY SIGN DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICE OR ANY QR CODE, DESTINATION, CONTENT, OR THIRD-PARTY SERVICE WILL BE SECURE, AVAILABLE, ACCURATE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINK MY SIGN AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR REPUTATION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF LINK MY SIGN FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID DIRECTLY TO LINK MY SIGN FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS ($100).

Amounts paid to Amazon for physical products are not amounts paid directly to Link My Sign for purposes of this limitation unless Link My Sign is legally treated as the direct seller. These limitations apply regardless of the theory of liability and to the fullest extent permitted by law. They do not limit liability that cannot lawfully be excluded or limited.

16. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Link My Sign and its members, managers, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable attorneys' fees arising from:

  • your User Content, destination URLs, products, services, listings, or transactions;
  • your violation of these Terms, the Acceptable Use Policy, or applicable law;
  • your infringement or violation of another person's rights; or
  • your fraud, misconduct, or misuse of the Service.

We may control the defense of a covered claim, and you agree to reasonably cooperate. You may not settle a claim in a way that admits fault by or imposes obligations on Link My Sign without our written consent.

17. Informal Dispute Resolution

Before filing arbitration or a lawsuit, the complaining party must send a written notice describing the dispute, supporting facts, requested relief, and contact information. Notices to Link My Sign must be emailed to legal@linkmysign.com with the subject "Notice of Dispute." We will send notices to the email associated with your account.

The parties will attempt in good faith to resolve the dispute informally for 30 days after receipt. Any applicable limitations period will be tolled during that period to the extent permitted by law.

18. Binding Arbitration and Class-Action Waiver

Agreement to Arbitrate

Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, a QR code, or the relationship between you and Link My Sign will be resolved by binding individual arbitration under the Federal Arbitration Act.

Arbitration will be administered by the American Arbitration Association ("AAA"). The AAA Consumer Arbitration Rules will apply when the dispute concerns an individual's personal or household use of the Service. The AAA Commercial Arbitration Rules will apply when the Service is used for or on behalf of a business or organization, unless the AAA determines that another AAA rule set applies. The arbitration may be conducted by telephone, video conference, written submissions, or in person as the applicable rules permit. The arbitrator may award the same individual remedies a court could award and will issue a reasoned decision.

AAA rules govern filing fees and arbitration costs. Link My Sign will pay fees it is required to pay under applicable law or AAA rules. Each party will bear its own attorneys' fees unless applicable law or the arbitrator permits an award.

Exceptions

Either party may:

  • bring an individual claim in small-claims court if it qualifies;
  • seek temporary or preliminary injunctive relief in court to prevent imminent misuse, security harm, or intellectual-property infringement pending arbitration; or
  • pursue a remedy that applicable law does not permit to be arbitrated.

Nothing in these Terms prevents reporting issues to a government agency or prevents an agency from seeking relief where authorized.

Class-Action and Jury-Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. YOU AND LINK MY SIGN WAIVE THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION OR ARBITRATION. YOU AND LINK MY SIGN ALSO WAIVE THE RIGHT TO A JURY TRIAL.

If a final decision determines that the class-action waiver is unenforceable for a particular claim or remedy, that claim or remedy will proceed in court after all arbitrable matters are resolved.

Arbitration Opt-Out

You may opt out of this arbitration agreement by emailing legal@linkmysign.com within 30 days after you first accept these Terms. Your notice must include your name, account email, and a clear statement that you opt out of the arbitration agreement. Opting out will not affect the other Terms and will not result in adverse treatment.

19. Governing Law and Courts

Florida law governs these Terms, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 18. For disputes not subject to arbitration, you and Link My Sign consent to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida, except where applicable consumer law requires otherwise.

20. Changes to These Terms

We may update these Terms to reflect Service, business, legal, or security changes. We will post updated Terms and revise the "Last Updated" date. If changes are material, we may provide additional notice. Changes apply prospectively from their effective date. Your continued use after the effective date constitutes acceptance where permitted by law.

21. General Terms

These Terms, the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any offer-specific terms form the entire agreement regarding the Service. If there is a conflict, offer-specific terms control only for the applicable purchase, followed by these Terms and then the other policies.

You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, sale of assets, or by operation of law. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain effective. Headings are for convenience only.

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, utility or internet failures, labor disputes, governmental actions, war, civil unrest, cyberattacks, third-party outages, or failures of hosting, domain, email, marketplace, or telecommunications providers.

Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs use of the services provided by LinkMySign, LLC ("Link My Sign," "we," "us," or "our"), including accounts, QR code tools, redirects, hosted features, and related services (collectively, the "Service"). This AUP is incorporated into the Link My Sign Terms of Service.

You are responsible for ensuring that your content, QR codes, destinations, signs, listings, products, services, and conduct comply with this AUP and all applicable laws.

1. Illegal and Harmful Activity

You may not use the Service to create, promote, facilitate, or conceal:

  • activity, products, services, transactions, or content that is illegal in the jurisdiction where it is offered, displayed, distributed, or accessed;
  • fraud, scams, deceptive practices, false advertising, or material misrepresentations;
  • theft, trafficking in stolen property, counterfeiting, or infringement of intellectual-property rights;
  • violence, credible threats, exploitation, abuse, or unlawful harassment;
  • unlawful discrimination or content that violates another person's legal rights;
  • regulated goods or services offered without all legally required licenses, disclosures, age controls, and other safeguards; or
  • attempts to evade law enforcement, sanctions, court orders, platform restrictions, or legal obligations.

Link My Sign does not undertake to determine whether every destination is lawful in every jurisdiction. You are solely responsible for that determination.

2. Deceptive QR Codes and Destinations

You may not:

  • disguise or materially misrepresent where a QR code leads;
  • use a QR code for phishing, credential theft, malware, ransomware, spyware, or harmful downloads;
  • impersonate another person, business, government entity, charity, or property owner;
  • falsely claim ownership, authority, sponsorship, certification, verification, or affiliation;
  • redirect scanners to content materially different from what the sign or surrounding context represents;
  • alter a destination after distribution in a way that makes the sign deceptive or harmful;
  • use confusing domains, lookalike pages, or false security warnings to mislead users; or
  • interfere with a scanner's ability to leave, navigate, or make an informed choice.

3. Content and Listings

You may not use the Service for content or listings that:

  • you do not have the right to publish, advertise, link to, or distribute;
  • are materially false, misleading, outdated, or omit information required by law;
  • violate copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights;
  • expose personal information without authorization or facilitate stalking, doxxing, identity theft, or harassment;
  • contain illegal sexual content or sexual exploitation;
  • make adult or explicit content unlawfully accessible to minors or fail to use legally required age restrictions;
  • unlawfully target, exploit, or endanger minors; or
  • contain code or files designed to damage, disrupt, monitor, or gain unauthorized access to systems or data.

You are responsible for promptly correcting or deactivating expired, sold, withdrawn, inaccurate, or unlawful listings.

4. Spam and Unwanted Communications

You may not use the Service to:

  • send spam or unlawful commercial messages;
  • harvest email addresses, phone numbers, credentials, or personal information;
  • facilitate robocalls, unsolicited bulk messages, or communications that violate consent or opt-out laws;
  • distribute QR codes through trespass, vandalism, unauthorized posting, or other unlawful placement; or
  • mislead recipients about the source, subject, or purpose of a communication.

5. Platform and Security Abuse

You may not:

  • probe, scan, test, or exploit vulnerabilities without our prior written authorization;
  • bypass authentication, access controls, rate limits, usage limits, or security measures;
  • access another user's account, content, or data without authorization;
  • introduce malicious code or interfere with the availability or integrity of the Service;
  • use bots, scripts, scraping, crawling, or automated systems in a manner that burdens, disrupts, copies, or extracts from the Service without permission;
  • reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it;
  • resell, sublicense, or provide unauthorized access to the Service;
  • create accounts or QR codes to evade enforcement; or
  • assist another person in prohibited conduct.

Ordinary use of publicly available search-engine indexing and standard browser functions is not prohibited unless it becomes abusive or violates other terms.

6. Respect for Third-Party Rules

When a QR code directs to Amazon or another third-party service, you must also comply with that service's terms, policies, and listing rules. Permission to use Link My Sign does not authorize activity prohibited by a third party.

7. Enforcement

We may review reports and investigate suspected violations. When we reasonably believe a violation occurred or action is needed to prevent harm, we may:

  • warn the user or request corrective action;
  • disable a QR code or redirect it to a Link My Sign safety, suspension, or unavailable notice;
  • remove or restrict content;
  • limit features or access;
  • suspend or terminate accounts;
  • preserve information relevant to an investigation;
  • notify affected third parties or service providers; or
  • report conduct to law enforcement or other authorities when appropriate or legally required.

We will generally tailor enforcement to the nature, severity, urgency, and history of the conduct. We may act without advance notice where necessary to address imminent harm, security threats, fraud, illegality, repeated violations, or legal restrictions.

We are not obligated to monitor every QR code, destination, or listing and do not assume responsibility for user content merely because we investigate or take enforcement action.

8. Reporting Violations

Report suspected violations to legal@linkmysign.com. Include:

  • the QR code, URL, account, or content at issue;
  • a description of the suspected violation;
  • supporting screenshots or documents, if available; and
  • your contact information.

Do not submit sensitive personal information unless necessary. Knowingly false, abusive, or bad-faith reports may themselves violate this AUP.

9. Changes

We may update this AUP to address new features, risks, legal requirements, or abuse patterns. We will post the updated version and revise the "Last Updated" date. Material changes may receive additional notice where required.
